1. Introduction

Welcome to Symphony of Colour Designer Jewellers. These Terms and Conditions govern your use of https://www.symphonyoc.co.za and the agreement between you ("the Client") and Symphony of Colour Designer Jewellers Pty Ltd (Reg Nr: K2026311958) regarding the design, manufacture, and purchase of bespoke jewellery.

2. The Bespoke Journey & Design Approval

Our design process includes concept discussions, CAD (Computer-Aided Design) rendering, and wax modeling.

  • Approval: Manufacturing will only commence once the Client has provided written or digital sign-off on the final CAD design or wax model with the agreed financial deposit amount.
  • Alterations: Any structural or design changes requested by the Client after the final design has been approved and manufacturing has commenced will incur additional labour and material costs.
  • Diamonds & Stones: Selected diamonds are placed on a 24-hour hold pending project confirmation.
  • If the hold lapses and the stone isn't available, we will source a suitable replacement, with comparable specs (clarity, cut, carat, colour) and inform the client immediately.
  • The client approves any adjustments prior to proceeding.

3. Quotations, Deposits, and Payments

  • Validity: All quotations provided are valid for 7 days due to the daily fluctuations in precious metal markets and global diamond/gemstone exchange rates.
  • Deposits: A non-refundable deposit (as stipulated in your final quotation) is required before any raw materials (metals, natural diamonds, or lab-grown diamonds) are sourced and before manufacturing begins.
  • Final Payment: The outstanding balance must be settled in full and cleared in our bank account before the final piece is handed over or shipped.

4. Material Variances and Tolerances

Due to the handcrafted nature of our bespoke items and the organic properties of natural materials:

  • Gemstones: Natural and lab-grown diamonds, as well as semi-precious stones, may exhibit slight variations in hue, tone or inclusion visibility depending on the lighting environment.
  • Metals and Weight: The final polished weight of gold, platinum, or palladium may feature micro-tolerances that differ marginally from the initial estimated digital 3D renders. These slight variations do not constitute a defect.

5. Ownership and Intellectual Property

All CAD designs, renders, sketches and prototypes created during the consultation process remain the intellectual property of Symphony of Colour Designer Jewellers, unless expressly agreed otherwise in writing. We reserve the right to showcase completed pieces or renders (maintaining client anonymity) on our website and social media platforms for marketing purposes.

6. Collection, Shipping, and Risk

  • In-Person: We recommend collecting your finished piece directly from our Centurion location by appointment. Risk of loss or damage passes to the Client the moment the jewellery is handed over.
  • Courier Transit: If a piece is shipped via an insured courier service, risk passes to the Client upon delivery and signature at the provided address. It is the Client's responsibility to ensure the piece is insured under their own personal policy from the moment of receipt.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts.
